State law allows the Texas Department of Family and Protective Services (DFPS) to release confidential records to local, state, or federal law enforcement official for the purpose of investigating crimes related to:
- Allegations of abuse, neglect, or exploitation of a DFPS client (including APS, CCL, and CPS).
- Allegations of false or malicious reporting of alleged abuse, neglect, or exploitation of a DFPS client.
- Failure to report alleged abuse, neglect, or exploitation of a DFPS client. [See Texas Administrative Code §§700.203 (a) (3), 705.7109 (1), and 745.8491].
