Revisions for Clarity and Consistency

The following minimum standard rules have been revised to increase clarity and consistency. Notice that while some of the rule numbers have been repealed, the rule content still applies and has been moved to another minimum standard rule. Due to the large number of minimum standard rules in this section, they have been grouped by those being repealed and those being amended.

Repealed Minimum Standard Rules

744.1019 Are any directors exempt from the qualifications?

This rule was repealed because it only contained grandfather clauses that are no longer applicable.

744.1031 Must the trainer or provider of clock hours meet specific criteria?

This rule was repealed because it was not accurate. 744.1319 Must the training for my caregivers and the director meet certain criteria? currently provides criteria for trainers.

744.1033 What are CEUs?

This rule was repealed because "CEUs" has been incorporated into the definitions rule at 744.123 What do certain words and terms mean when used in this chapter?.

744.1039 What documentation must I have to prove that the person received the clock hours or CEUs?

This rule was repealed. Its content has been added to 744.1035 May clock hours or CEUs (continuing education units) be substituted for any of the educational requirements in this division?.

744.1041 What documentation must I provide to Licensing to show that my director has acceptable child development and management education?

This rule was repealed. Its content has been added to 744.1029 What documentation must I provide to Licensing to show that my director has an acceptable child development and management education?.

744.1101 What is the difference between an employee and a caregiver?

This rule was repealed. Its content has been incorporated into the new definition for "employee" and the revamped definition for "caregiver" at 744.123 What do certain words and terms mean when used in this chapter?

744.1111 What does Licensing mean by the term "high school equivalent"?

This rule was repealed. Its content has been added to 744.1105 What additional minimum qualifications must each of my caregivers meet?.

744.1327 What is self-instructional and instructor-led training?

This rule was repealed. The definitions for self-instructional and instructor-led training have been added to the definitions rule at 744.123 What do certain words and terms mean when used in this chapter? and the content for subsection (c) has been added to 744.1319 Must the training for my caregivers and the director meet certain criteria?.

744.1403 What minimum standards must volunteers or any person under contract with my operation comply with?

This rule was repealed. Its content has been added to amended 744.1401 What minimum standards must substitutes, volunteers, or persons under contract with my operation comply with?.

 

Amended Minimum Standard Rules

744.1001 Am I required to have a director for my operation?

This rule has been amended to delete the redundant requirement to notify Licensing when there is a change in directors because this is already required in 744.303 What changes must I notify Licensing of regarding the governing body, a director, or the program at my operation?.

744.1003 If I have multiple operations, must I designate a director for each operation?

The language in this rule has been amended for better readability and ease of understanding.

744.1015 What qualifications must an operation director or program director meet?

This rule has been amended to delete the notification that some qualifications for an operation or program director require periodic renewal to remain qualified because this information is already included in 744.1051 Will the director's certificate expire? and 744.1053 How often must an expiring certificate be renewed?. However, this information and the citations of the relevant rules regarding the renewal of an operation or program director's certificate have been added to the Helpful Information box following this rule.

744.1017 What qualifications must a site director meet?

This rule has been amended to clarify that the operation must provide Licensing a written plan describing the oversight the program director will be providing the site director until the required education qualifications are completed, including the sharing of director responsibilities, if applicable.

744.1023 Can Licensing verify whether someone has sufficient experience?

The language in this rule has been amended for better readability and ease of understanding.

744.1029 What documentation must I provide to Licensing to show that my director has an acceptable child development and management education?

This rule has been amended to delete the former title (What are clock hours?) and the definition of clock hours because this definition has been moved to 744.123 What do certain words and terms mean when used in this chapter? and to add content from repealed 744.1041 What documentation must I provide to Licensing to show that my director has acceptable child development and management education?.

744.1035 May clock hours or CEUs (continuing education units) be substituted for any of the educational requirements in this division?

This rule has been amended to incorporate the content from repealed 744.1039 What documentation must I have to prove that the person received the clock hours or CEUs?. The wording of the question and the answer have also been modified for ease in understanding the rule.

744.1037 What kind of documentation must I submit to Licensing to show my director is qualified and when must I submit it?

This rule has been amended to clarify that a director must meet qualifications outlined in this rule in addition to the employee qualifications and caregiver qualifications, if applicable.

744.1051 Will a director's certificate expire?

This rule has been amended to specify content for site, operation and program directors.

744.1053 How often must an expiring certificate be renewed?

This rule has been amended to specify content for operation and program directors.

744.1055 What happens if my operation director's or program director's credential expires?

This rule has been amended to clarify the language and to specify that the requirements apply to operation and program directors.

744.1103 What minimum qualifications must each of my employees meet?

The introductory language of this rule has been amended for simplification and accuracy.

744.1203 What additional responsibilities do my caregivers have?

This rule is being amended to clarify the language by:

• deleting "counted in the child/caregiver ratio" from the rule question and introduction because this will be a part of the new definition of a caregiver, which means the language is no longer necessary;

• changing "administrative and clerical functions" to "administrative and clerical duties", because "duties" is what is defined at 744.123; and

• deleting the examples of "janitorial duties" and incorporating them in the definition for "janitorial duties" at 744.123. 

744.1301 What training must I ensure that my employees have?

This rule has been amended to clarify the understanding by:

• creating a chart for better readability;

• clarifying which training requirements are for employees and caregivers; and

• deleting the director training requirements which are already outlined in 744.1309 How many clock hours of annual training must be obtained by caregivers and site directors? and 744.1311 How many clock hours of training must an operation director or a program director obtain each year?.

744.1317 What additional training must a person have in order to transport a child in care?

This rule is being amended to make the use of "employee" consistent throughout the rule; and to clarify "owner" in the definition of an "employee" at 744.123.

744.1319 Must the training for my caregivers and the director meet certain criteria?

This rule is being amended to:

• update the title of the training registry;

• clarify that a Child Development Associate credential must be current;

• delete the statement that self-instructional training cannot be used for CPR or first aid certification because it is redundant and is already included in 744.1315 Who must have first-aid and CPR training?; and

• clarify that training inclusion requirements outlined in revised subsection (c) apply to both instructor-led and self-instructional training, but do not apply to self-study training.

744.1321 Does Licensing approve training resources or trainers for training hours?

This rule has been amended to clarify that while Licensing does not approve training resources, training must comply with the criteria specified in 744.1319 Must the training for my caregivers and the director meet certain criteria?, required training topics and documentation requirements.
