Revisions for Clarity and Consistency

The following minimum standard rules have been revised to increase clarity and consistency. Notice that while some of the rule numbers were repealed, the rule content still applies and has been moved to another minimum standard rule. Due to the large number of minimum standard rules in this section, they have been grouped by those being repealed and those being amended.

Repealed Minimum Standard Rules

746.1019 Are any directors exempt from the qualifications?

This rule has been repealed as it only contained grandfather clauses that are no longer applicable.

746.1033 Must the trainer or provider of clock hours meet specific criteria?

This rule was repealed because it was not accurate. 746.1317 Must the training for my caregivers and the director meet certain criteria? currently provides criteria for trainers.

746.1035 What are CEUs?

This rule was repealed. "CEU" is now defined in 746.123 What do certain words and terms mean when used in this chapter?.

746.1041 What documentation must I have to prove that the person received the clock hours or CEUs?

This rule was repealed. Its content has been moved to 746.1037(c) May clock hours or continuing education units (CEUs) be substituted for educational requirements in any of the options specified in this division?.

746.1043 What documentation must I provide to Licensing to show that my director has acceptable child development and business management education?

This rule number was repealed. Its content has been moved to 746.1031 What documentation must I provide to Licensing to show that my director has acceptable child development and business management education? for better readability and flow of the rules.

746.1101 What is the difference between a child-care center employee and a child-care center caregiver?

This rule is being repealed and its content is being incorporated into the new definition for "employee" and the revamped definition for "caregiver" at 746.123 What do certain words and terms mean when used in this chapter?.

746.1103 Are there different personnel qualifications for employees and caregivers?

This rule was repealed because it was redundant. The information is already included in 746.1105 What minimum qualifications must each of my child-care center employees meet? and 746.1107 What additional minimum qualifications must each of my caregivers meet?. However, the graphic with some modifications has been moved to a Helpful Information box after 746.1107 What additional minimum qualifications must each of my caregivers meet?.

746.1113 Do the caregiver qualifications specified in this division apply to a caregiver that was employed before May 1, 1985?

This rule was repealed because the grandfather clause was outdated and no longer necessary.

746.1115 What does Licensing mean by the term "high school equivalent"?

This rule was repealed. Its content has been moved to 746.1107(2)(B)(i) What additional minimum qualifications must each of my caregivers meet?.

746.1325 What is self-instructional and instructor-led training?

This rule was repealed. The definitions for self-instructional and instructor-led training have been moved to the definitions rule at 746.123 What do certain words and terms mean when used in this chapter?. The content from subsection (c) has been moved to 746.1317(d) Must the training for my caregivers and the director meet certain criteria?.

746.1403 What minimum standards must volunteers or any person under contract with the center comply with?

This rule was repealed. Its content has been moved to 746.1401 What minimum standards must substitutes, volunteers, or persons under contract with my center comply with?.

 

Amended Minimum Standard Rules

746.1015 What qualifications must the director of my child-care center licensed for 13 or more children meet?

This rule has been amended to add citations of the relevant rules regarding the renewal of a director's certificate (for a center licensed for 13 or more children).

746.1017 What qualifications must the director of my child-care center licensed for 12 or fewer children meet?

This rule has been amended to add citations of the relevant rules regarding the renewal of a director's certificate (for a center licensed for 12 or fewer children).

746.1021 What constitutes experience in a licensed child-care center, or in a licensed or registered child-care home?

This rule has been amended to modify the language of the rule for better readability and ease of understanding.

746.1029 What credit courses does Licensing recognize as management?

This rule has been amended to clarify that the rule addresses "business" management.

746.1031 What documentation must I provide to Licensing to show that my director has acceptable child development and business management education?

This rule has been amended to:

• delete "Clock hours," which has been moved to the definitions rule at 746.123 What do certain words and terms mean when used in this chapter?, with some modifications for clarity and accuracy; and

• add content from 746.1043 What documentation must I provide to Licensing to show that my director has acceptable child development and business management education?, which has been moved to this location for better readability and flow of the rules.

746.1037 May clock hours or continuing education units (CEUs) be substituted for any of the educational requirements specified in this division?

This rule has been amended to incorporate the content from repealed 746.1041 What documentation must I have to prove that the person received the clock hours or CEUs?. The wording of the question and the answer has also been modified for ease in understanding the rule.

746.1039 What kind of documentation must I submit to Licensing to show my child-care center director is qualified and when must I submit it?

This rule has been amended to clarify that a director must meet qualifications outlined in this rule in addition to the employee qualifications and caregiver qualifications, if applicable.

746.1057 What happens if I do not submit the documentation confirming the credential is current?

This rule has been amended to clarify the language of the rule for better readability and ease of understanding.

746.1105 What minimum qualifications must each of my child-care center employees meet?

The introductory language of this rule has been amended for simplification and accuracy.

746.1203 What additional responsibilities do my caregivers have?

This rule is being amended to clarify the language by:

• deleting "counted in the child/caregiver ratio" from the rule question and introduction because this will be a part of the new definition of a caregiver, which means the language is no longer necessary;

• changing "administrative and clerical functions" to "administrative and clerical duties", because "duties" is what is defined at 746.123; and

• deleting the examples of "janitorial duties" and incorporating them in the definition for "janitorial duties" at 746.123. 

746.1301 What training must I ensure that my employees have?

This rule has been amended to clarify the understanding by:

• creating a chart for better readability;

• clarifying which training requirements are for employees and caregivers;

• deleting the director training requirements which are already included in 746.1311 How many clock hours of training must my child-care center director obtain each year?; and

• deleting the outdated requirement for the training of caregivers hired before September 1, 2011 date.

746.1316 What additional training must a person have in order to transport a child in care?

This rule has been amended to make the use of "employee" consistent throughout the rule and to clarify "owner" in the definition of an "employee" at 746.123.

746.1317 Must the training for my caregivers and the director meet certain criteria?

This rule is being amended to:

• update the title of the training registry;

• clarify that a Child Development Associate credential must be current;

• delete the statement that self-instructional training cannot be used for CPR or first aid certification because it is redundant and is already included in 746.1315 Who must have first-aid and CPR training?; and

• clarify that training inclusion requirements outlined in revised subsection (c) apply to both instructor-led and self-instructional training, but do not apply to self-study training.

746.1319 Does Licensing approve training resources or trainers for training hours?

This rule has been amended to clarify that while Licensing does not approve training resources, training must comply with the criteria specified in 746.1317 Must the training for my caregivers and the director meet certain criteria?, required training topics and documentation requirements.
