Revisions for Clarity and Consistency

The following minimum standard rules have been revised to increase clarity and consistency. Notice that while some of the rule numbers were repealed, the rule content still applies and has been moved to another minimum standard rule.

747.603 What records must I have for children in my care and how long must I keep them?

This rule has been amended to clarify that:

• admission information is information required in 747.605 What admission information must I obtain for each child?;

• TB screening is only needed if required by the Texas Department of State Health Services (DSHS) or a local health authority; and

• documentation from a health care professional that allows a deviation from minimum standards must be maintained in the child's record.

747.613 What immunizations must a child in my care have?

This rule has been amended to clarify that:

• current immunization records must be maintained, including records of any exemptions or exceptions; and

• the situations where immunizations are not required by the date of admission, including exemptions, exceptions, and provisional enrollment for up to 30 days for homeless children or children in foster care.

747.615 What exemptions or exceptions are there concerning immunization requirements?

This rule has been amended to further explain the immunization exemptions and exceptions that are allowed by the DSHS rules.

747.617 Where can I find more information on immunizations?

747.619 When must I have the child's immunization records on file?

747.621 May I admit a child who is not current on immunizations?

747.625 If a child's immunization record is already on file at a pre-kindergarten program or school away from my child-care home, must I also have a copy of the child's immunization record in my files?

747.703 Where can I get a copy of Licensing's Incident/Illness Report form?

747.705 Must someone from my child-care home sign the Incident/Illness Report form?

The language in this rule has been amended for better readability and ease of understanding.

747.801 What records must I keep at my child-care home?

The language in this rule has been amended for better readability and ease of understanding. In addition, redundant content has been deleted, including:

• the requirement to keep proof of background checks because it is already required in 747.901 What information must I maintain in my personnel records?; and

• the requirement to keep a copy of the most recent Licensing inspection, report or letter since this is already a record that is required to be posted in 747.401 What items must I post at my child-care home during hours of operation?.

747.803 How long must I keep records at my child-care home?

This rule has been amended to clarify that a posted record must also be kept for at least three months from the date the record was created.

747.907 Where can I obtain a copy of the Licensing Affidavit for Applicants for Employment form?

This rule was repealed because it was not measurable. The content of this rule has been added to a Helpful Information box.

747.909 What records must I maintain on myself?

This rule has been amended to delete the requirement to maintain an affidavit for the primary caregiver because this form is only required for applicants for employment.
