Subchapter W. Minimum Standard Rule Revisions that May Affect Compliance

Fire Extinguisher

747.5105 Where must I mount fire the extinguisher?

This rule has been amended to clarify that if the state or local fire marshal or the manufacturer's instructions for mounting a fire extinguisher are different from those outlined in minimum standard rules, you must follow those instructions.

Does this mean that if my operation follows the manufacturer's mounting instructions and they are different from the minimum standard rule requirements for mounting, I will not be cited?

Yes. In fact, your operation is required to follow the manufacturer's mounting instructions. If the manufacturer does not provide specific instructions, you should follow those outlined in minimum standard rules unless directed otherwise by your state or local fire marshal.

747.5115 How often must the smoke detectors at my child-care home be tested?

In addition to clarifying the language for better readability and ease of understanding, this rule has been amended to add a documentation requirement for the date of installation of new batteries.

What does this mean?

As you perform your monthly inspection of smoke detectors, you must document the date you replaced the batteries, when applicable. You only have to replace the smoke detector batteries if you find they are no longer working.
