Human Resources Code (HRC) Chapter 42 - Listed Homes

  • Limits the number of children allowed in care to 3 or less unrelated children.
  • Does not require inspections. (An inspection may occur as the result of a report.)

Definition: Unrelated Children - Children who are not children, grandchildren, siblings, great-grandchildren, first cousins, nieces, or nephews of the caregiver, whether by affinity or consanguinity or as the result of a relationship created by court decree. TAC 745.21 (9)

Minimum Standards - Registered and Licensed Homes

Minimum standards include different topics such as number of children allowed in care, record keeping, child development, discipline, and transportation.

Your inspection results must demonstrate compliance with all minimum standards before you will receive a permit to care for children. Number of Children - Registered homes may have up to 6 children under age five in care, including related and unrelated children. Up to 6 additional school-age children may be in care after school. Licensed homes may have up to 12 children in care at any one time, including related and unrelated children.
