This revision of the Adult Protective Services Handbook was published on February 15, 2021. Summaries of new or revised items are provided below.

Rewrite of APS Handbook

APS has reformatted its handbook from five chapters to 16.

This revision does the following throughout the handbook:

  • Reorganizes and clarifies information.
  • Makes Procedure and Documentation subheadings of other policy sections.

Additional revisions in each chapter are described below.

Reference tables showing the old and new locations of content appear at the end.

1000 Program Overview: Adult Protective Services (APS) (PATS 12217)

This revision does the following:

  • Adds policy about impartiality of interpreters.
  • Makes various minor updates.

2000 Statewide Intake (SWI) and Case Assignment (PATS 12218)

This revision does the following:

  • Removes supervisor consultation requirement for CRSRs.
  • Removes supervisor consultation requirement for assigning secondary APS specialists to cases.
  • Incorporates procedural memo PM 18-004, about procedure for after-hours Priority I intakes.

3000 Scope and Eligibility (PATS 12618)

This revision does the following:

  • Removes supervisor consultation for when HHSC Long-Term Regulatory does not assume jurisdiction of an allegation.
  • Removes consultation with regional attorney to determine if a release of information to the facility or provider agency is needed.
  • Clarifies information about when APS would investigate someone receiving hospice services.
  • Incorporates memo PM 18-001, about making referrals to Health and Human Services.

4000 Cases Involving Health and Human Services Commission (HHSC) or Other Settings (PATS 12612)

This revision does the following:

  • Changes consultation with regional attorney to as needed, rather than required, when APS provides consent to medical treatment for a client.
  • Updates information for who to contact when waste, abuse, or fraud within the Texas Health and Human Services system is suspected.

5000 Complex Cases (PATS 12422)

This revision does the following:

  • Removes the supervisor consultation requirement for approval to provide services for a client who is an undocumented person.
  • Removes the requirement for a subject matter expert (SME) consultation to make sure all relevant evidence is collected and all safety concerns are identified during complex investigations.

6000 Evidence Collection (PATS 12582)

This revision does the following:

  • Removes supervisor consultation requirement when evidence is unavailable or difficult to collect.
  • Clarifies that only an adult resident of the home can give APS permission to enter the home.
  • Removes language about using air cards.
  • Incorporates policy memo PR 18-003, about interview requirements during the investigation.
  • Clarifies instructions for when APS receives photos, video, or audio from people or entities outside DFPS.

7000 Guardianship Cases (PATS 12427)

This revision does the following:

  • Removes the supervisor consultation requirement to release criminal history information if the court orders the APS specialist to do so.
  • Adds a regional attorney consultation requirement to release criminal history information if the court orders the APS specialist to do so.
  • Removes the subject matter expert (SME) consultation requirement about the appropriateness of a guardianship referral.
  • Removes the term “probate” when referring to courts.
  • Adds information about APS involvement in guardianship referrals.
  • Clarifies to whom APS makes a guardianship referral when a client lives in Harris or Galveston County.

8000 APS Investigations (PATS 12642)

This revision does the following:

  • Updates requirements for verifying self-neglect is Resolved Before Initial Face-to-Face.
  • Clarifies that a self-neglect conclusion summary is not required when closing a case as Valid, Resolved Before Initial Face-to-Face.
  • Adds procedure for completing the Safety Assessment when the alleged victim is inaccessible for the initial face-to-face contact.
  • Clarifies that HHSC Provider Investigations investigates Medicaid-paid providers who are also family members or others with an ongoing relationship, regardless of whether they are on or off duty.

9000 Case Contacts (PATS 12219)

This revision does the following:

  • Adds procedure for how to handle safety and service contacts when the alleged victim or client dies, but the case will remain open to investigate the allegations.
  • Updates language for documentation requirement to reflect that the APS specialist enters documentation by 11:59 p.m. the next business day, rather than within 24 hours.
  • Incorporates policy release memo PR-19-001R, about safety and service contacts.
  • Updates language for verifying self-neglect is Resolved Before Initial Face-to-Face.
  • Clarifies that a self-neglect conclusion summary is not required when closing a case as Valid, Resolved Before Initial Face-to-Face.
  • Adds procedure for completing the Safety Assessment when the alleged victim is inaccessible for the initial face-to-face contact.

10000 Providing and Arranging for Services (PATS 12220)

This revision does the following:

  • Clarifies policy about when and to whom services can be provided.
  • Restructures policy section related to the APS service plan.
  • Clarifies policy about financial exploitation and Medicaid eligibility when resources have been transferred out of the client’s name.
  • Clarifies policy about methods of purchased client services (PCS).

11000 Maintenance and Intensive Case Services (PATS 12287)

This revision reorganizes and clarifies policy about Maintenance and Intensive Case Services.

12000 Death of an Alleged Victim or Client (PATS 12284)

This revision adds procedure for how to capture safety and service contacts when the client dies, but the case will remain open to investigate the allegation(s).

13000 Legal Actions, Legal Documents, and Other Non-Legal Remedies (PATS 12578)

This revision does the following:

  • Updates name for Emergency Order for Protective Services (EOPS) to Original Petition for Emergency Order for Protective Services.
  • Incorporates policy memo PR 18-001R, which is about requesting transaction holds from financial institutions and securities professionals.

14000 Case and Stage Closure (PATS 12221)

This revision adds language to the “Does not Meet” policy to clarify that a missing person, when there are no other allegations of abuse, neglect, or financial exploitation, is not appropriate for an APS investigation.

15000 Due Process and Release of Information (PATS 12617)

This revision does the following:

  • Removes Consumer Directed Services (CDS) information from the Employee Misconduct Registry (EMR) sections.
  • Changes the process for requesting case records when a school employee requests an administrative review.
  • Adds client protection as a reason for non-EMR due process.
  • Updates language for making an emergency release when a perpetrator may have access to children.
  • Adds information about Notice of Findings to Employer during the EMR process.
  • Removes information about Notice of Findings after non-EMR due process, when there is also an EMR hearing pending.
  • Adds information about a request for a rehearing in EMR cases.
  • Adds information to the judicial review process for EMR cases.

16000 Confidentiality and Integrity of Records (PATS 12285)

This revision does the following:

  • Removes reference to “administrative” when referring to desk review.
  • Adds that the Office of Inspector General is included as a law enforcement agency.
  • Incorporates memo for sharing confidential information with other entities to provide services, as necessary.
  • Updates procedure for release of case information to state supported living centers.
  • Clarifies the time frame for entering external documentation into IMPACT.
  • Updates the retention and destruction schedule for APS case records.

Appendices (PATS 12702)

This revision updates the following appendices:

  • Facilities and Jurisdictions
  • APS Decision-Making Tree
  • Definitions of Person Characteristics

All other APS appendices have been moved to the APS section of the DFPS intranet, incorporated into the main text of the handbook, or deleted.
